These Terms & Conditions (“Terms”) govern your use of fyberlabs.com and your purchase of products and services from Fyber Labs (“we,” “our,” or “us”). By placing an order or using our services, you agree to these Terms. Please read them carefully.
1. Products and Services
Fyber Labs offers the following categories of products and services:
- Electronics and hardware: Open-source wearable electronics modules, development kits, sensors, actuators, and related components.
- Professional-grade hardware: Certain products (sold under the Tennessee Windage brand) are subject to additional restrictions; see Section 7 (Export and Restricted Products).
- SaaS and network solutions: IT consulting engagements, network architecture and DevOps services, and any software-as-a-service offerings we make available.
- Training systems: Force-on-force laser training hardware and associated software for safety training use.
All product descriptions, specifications, and availability are subject to change without notice.
2. Orders and Payment
Order acceptance. Your order constitutes an offer to purchase. We reserve the right to accept, decline, or cancel any order at our sole discretion, including after payment is received. If we cancel your order after charging you, we will issue a full refund.
Pricing. All prices are in US dollars (USD) and do not include applicable taxes unless stated otherwise. Taxes, duties, and shipping fees are calculated and displayed at checkout.
Payment processing. Payments are processed by Stripe, Inc. through a secure checkout session. By completing a purchase, you also agree to Stripe’s Terms of Service. We do not store your payment card details.
3. Refunds and Returns
Physical hardware. Unused hardware in original, undamaged packaging may be returned within 30 days of delivery for a refund of the product price (less original shipping costs). Contact us via the contact form to initiate a return. You are responsible for return shipping. We reserve the right to refuse returns of opened electronic components for safety and hygiene reasons.
Consulting and services. Fees for consulting hours already performed are non-refundable. For retainer or project-based engagements, refund terms will be stated in the applicable statement of work.
Restricted products. Products sold under the Tennessee Windage line are not returnable once shipped except in the case of a verified defect.
Defective or damaged items. If you receive a defective or incorrectly shipped item, contact us within 14 days of delivery and we will arrange a replacement or refund at no additional cost to you.
4. Shipping
We ship within the United States only for physical hardware products. Shipping carriers, estimated delivery times, and rates are shown at checkout. Title and risk of loss for physical products transfer to you upon handoff to the carrier. We are not responsible for carrier delays or losses after handoff; however, we will work with you to resolve carrier disputes.
Delivery addresses must be within the United States. Orders with non-US shipping addresses will not be fulfilled and will be refunded.
5. Consulting and SaaS / Network Services
Consulting engagements. Hourly consulting services are delivered remotely. Each engagement is governed by a mutually agreed scope of work. We retain all intellectual property rights in methodologies, tools, and pre-existing work; deliverables developed specifically for a client will be addressed in a separate written agreement.
SaaS and network solutions. If we provide software access, network tooling, or managed services, the following apply:
- You may not use our services to transmit malware, conduct unauthorized access, violate applicable law, or facilitate any activity prohibited under US federal or state law.
- We reserve the right to suspend or terminate access for violation of these Terms or for conduct that endangers the security or integrity of our services.
- Service-level and uptime commitments, if any, are defined in a separate service agreement.
6. Intellectual Property
All content on this website — including text, images, logos, product designs, firmware source code made available under an open-source license, and other materials — is owned by or licensed to Fyber Labs. You may not copy, distribute, or create derivative works from our proprietary content without prior written consent.
Open-source hardware and firmware published by Fyber Labs is governed by the applicable open-source license stated in the relevant repository. These Terms do not limit rights granted by those licenses.
Fyber Labs holds patents including US 10,498,443 and US 9,541,352. Purchase of a product does not convey any license to those patents beyond the right to use the purchased item.
7. Export Control and Restricted Products
Certain products, particularly those in the Tennessee Windage line and any hardware or software subject to the International Traffic in Arms Regulations (ITAR, 22 CFR Parts 120–130) or Export Administration Regulations (EAR, 15 CFR Parts 730–774), may only be sold to and used by qualifying persons within the United States.
By purchasing a restricted product, you represent and warrant that:
- You are a US citizen, lawful permanent resident, or other US person as defined under applicable export control law.
- The shipping destination is within the United States.
- You are legally permitted to possess and use the product under applicable federal, state, and local law.
- You will not re-export or transfer the product to any unauthorized person.
International orders for restricted products will not be fulfilled and will be refunded. Fyber Labs reserves the right to require additional verification before fulfilling any order for restricted products.
8. Warranties and Disclaimers
Hardware products are warranted against defects in materials and workmanship for 90 days from the date of delivery (“Limited Warranty”). This Limited Warranty does not cover damage from misuse, unauthorized modification, accidents, or use outside the product’s rated specifications.
EXCEPT AS STATED ABOVE, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Consulting and SaaS deliverables are provided on a best-efforts basis. We do not warrant that our services will meet every specific requirement or that they will be uninterrupted or error-free.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FYBER LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total cumulative liability to you for any claim arising out of or related to a specific order shall not exceed the amount you paid for the product or service giving rise to the claim.
10. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in a court of competent jurisdiction within the United States. You consent to personal jurisdiction in such courts.
11. Changes to These Terms
We may update these Terms at any time. The current effective date is shown at the top of this page. Continued use of our site or services after an update constitutes acceptance of the revised Terms.
